Agency contract red-flag check

Open your contract and tick every statement that's true for it. You see each red flag, why it costs you and what to ask your agency instead, built from our guide to contract red flags. You never upload anything: the check runs in your browser.

Not legal advice. None of these clauses is automatically unlawful, and most are negotiable. For a signed contract or a dispute, ask a lawyer licensed where you live.

Tick a box when your contract says this, or when it says nothing on the point. Leave it empty when the contract gets it right.

The 15 clauses this check looks for

Each clause below comes with why it costs you, what to ask for instead and how our own contract handles it.

Already signed? What to do next

No boxes ticked. If none of these statements is true for your contract, that's a good sign. Still run the 5-minute self-check and put your notice date in your calendar.

Flag · Commission basis

Commission is taken from gross, or no basis is stated

OnlyFans keeps 20% of what fans spend. The same percentage taken before that fee costs you more: 40% of gross is 50% of what you're paid (illustrative math, not a client result).

What to ask your agency

“[X]% of net, meaning what OnlyFans pays out to me, as shown on my monthly statement.”

Ours: commission on net, never on gross.

Gross vs net, clause by clause

Flag · Upfront fees

Upfront, setup, tool or editing fees

Money paid before any result moves the risk onto you.

What to ask your agency

“No upfront, setup or tool fees, and no other fees unless I approve them in writing.”

Ours: no upfront, setup, tool or editing fees. Paid ads only on a budget you approve in writing.

The 14 things to get in writing

Flag · After you leave

Commission continues after the contract ends

You keep paying the old agency after you leave. Add a new agency and you pay twice for the same fans.

What to ask your agency

“No commission on any fan, sale or content after the end date. The final invoice covers the last month worked.”

Ours: no commission after the end date, on old fans or new ones.

Commission after you leave

Flag · Payouts

Your payouts go to an account in the agency's name

Your money passes through their hands first, and you can't check what was taken.

What to ask your agency

“OnlyFans pays me directly. You invoice me from my statement.”

Ours: payouts go from OnlyFans to your bank, and we invoice you.

Where your payouts go

Flag · Renewal

A fixed term that renews itself unless you opt out in time

Your real deadline is the opt-out window, not the end date. Miss it and a new term starts.

What to ask your agency

“Month-to-month, [X] days' written notice from either side, no automatic renewal.”

Ours: month-to-month, 30 days' notice, no auto-renewal.

Find your last day to give notice

Flag · Exit fee

An exit fee or early-termination fee

Leaving costs more than it should, so you keep paying through a bad stretch.

What to ask your agency

“Either party may end this agreement for any reason with [X] days' written notice, with no exit fee.”

Ours: no exit fee.

One-sided exit terms

Flag · Exit, both sides

The agency can leave on shorter notice or easier terms than you

If the answers differ, the contract is built to keep you, not them.

What to ask your agency

“The same notice, fees and handover, whoever ends it.”

Ours: 30 days either way, no exit fee, the same handover.

Can the agency leave on easier terms?

Flag · Holding your accounts

The agency may hold content, pages or access “until all amounts are paid”

In a billing dispute, that turns your own accounts into leverage.

What to ask your agency

“My content, pages and access come back to me on the end date. Any open invoice is settled separately.”

Ours: access removed within 24 hours of the end date; pages and their followers go with you.

Exit terms, both sides

Flag · Login and 2FA

You had to hand over your login, email or a 2FA code

Whoever holds your email and 2FA controls the account and can lock you out of your own page.

What to ask your agency

“My login, email, 2FA and payouts stay mine. Access is set up on a call where I enter the code myself.”

Ours: chat access is set up on a call where you enter the 2FA code yourself. We never ask for codes by message.

Who controls your login

Flag · Content license

A perpetual or irrevocable license to your content, or rights to “derivative works”

“Perpetual” and “irrevocable” mean the license survives your exit. “Derivative works” can cover re-edits, compilations and AI-generated material built from your photos and videos.

What to ask your agency

“I own all content, including edits the agency makes. The license ends on the end date, nothing AI-generated of me is published without my written approval, and the agency deletes its copies within [X] days.”

Ours: your content stays yours, including our edits. Our copies are deleted within 14 days of the end date.

Who owns your content

Flag · Marketing pages

Marketing pages are “Agency property” or run on the agency's emails

The audience you paid to build stays with them when you leave.

What to ask your agency

“Every marketing page is registered to an email I own and goes with me at exit.”

Ours: distribution pages are registered to emails you own. Handles, followers and posted content go with you.

Logins, email and pages

Flag · Exclusivity

Exclusivity covers all your platforms, brand deals, or a non-compete after you leave

It can cover the Instagram you run yourself and deals they never touched, and block you from hiring anyone after you leave.

What to ask your agency

“Exclusivity covers only the services listed in this agreement, only during the term.”

Ours: exclusive only for the services we run.

How wide is the exclusivity clause?

Flag · Deliverables

Deliverables are vague: “commercially reasonable efforts”, “as Agency deems appropriate”

If the services aren't defined, you can't show they weren't delivered.

What to ask your agency

“A written list of deliverables with numbers and cadence: how many videos a week and on which platforms, chat hours, report day, reply time.”

Ours: several Reels and TikToks a week, a written report every Monday, chat 24/7.

Does the contract say what they do?

Flag · Reports

No written reports, or reports not built from your statements

Without a report built from your statements, nobody can say where this week's money came from.

What to ask your agency

“A written report on a fixed day, built from my OnlyFans statements, that I can check myself.”

Ours: a written report every Monday, built from your OnlyFans statements.

What good reporting looks like

Flag · Chat and AI policy

Nothing in writing about who chats with your fans, or whether AI writes messages

Every message from your account goes out in your name, so you need to know who writes it.

What to ask your agency

“A written chat policy: who chats, from which brief, and where AI is and isn't used.”

Ours: every fan-facing message is written by a human chatter. AI tools may help with editing and captions.

Who chats with your fans

Not legal advice. The example wording comes from our guide and is illustrative, not taken from any specific agency's contract. Don't breach a contract you've signed: keep paying invoices that are due, and ask a lawyer before you act on post-exit commission with no end date, a perpetual license, an exit fee, payout routing, or any threat to keep your content or pages.
