Can an OnlyFans agency keep taking commission after you leave?

Only if your contract says so. Commission for the weeks of your notice period is normal, because the agency is still working. Commission on what you earn after the end date is a separate clause, often called a tail, trailing or residual commission. Below: how these clauses work, where to find them, what to check and what fair exit terms look like.

The short answer

Can an OnlyFans agency keep taking commission after you leave?

In short: only if your contract gives it that right. Until your end date the agency still works for you and is still paid, so commission during the notice period is normal. After the end date, an agency can only bill you if a clause says so: a post-term, tail, trailing or residual commission, usually on fans “acquired during the term”, for a set number of months, or with no end at all. Without such a clause, the final invoice should cover the work up to your last day and nothing after it.

Before you give notice, find out three things: whether a post-exit clause exists, what it's calculated on, and when it ends. Then check whether a “survival” clause keeps the commission section alive after termination. Fair terms end commission on the end date, for old fans and new ones, and that's how Fan Fusion LLC contracts work. This guide is general information, not legal advice.

Is commission during notice the same as commission after you leave?

No. They come from different clauses, and mixing them up is how creators get surprised by their last invoice.

How commission during the notice period differs from a post-term or tail commission after the end date
QuestionDuring the notice periodAfter the end date
What is it?Commission for the last weeks the agency still worksCommission on income after the agency has stopped working
Where does it come from? The notice clause in your contractA separate post-term, tail or survival clause

Your notice period sets your end date, and with it how long normal commission runs. Count it from the date and channel your contract names. If your contract renews itself unless you opt out in time, the notice date calculator finds the last day you can still give notice.

How do post-term and tail commission clauses work?

A tail clause sends a share of your income to the agency after the contract ends, usually on the argument that it built an audience you keep earning from. The versions differ in what they count and for how long.

  1. Fans acquired during the term

Commission on what subscribers who joined while the agency worked for you go on to spend. Hard to check, and after a long contract it can cover most of your fans.

Search for“acquired”, “introduced”, “generated by Agency”

  2. A fixed tail period

The full rate, or a reduced one, on all your earnings for a set number of months after the end date. Easy to calculate, but you may pay two agencies at once.

Search for“following termination”, “for a period of”, “tail”

  3. No end date

Commission on certain fans or content “for as long as” they bring in money. The most expensive version, because nothing ever closes it.

Search for“for as long as”, “in perpetuity”, “residual”

  4. Content the agency produced

A share of what sells from content it shot, edited or planned. It often sits next to a perpetual license to your content.

Search for“derivative”, “produced by Agency”, “license”

  5. A survival clause

A line near the end listing the sections that “survive” termination. If the commission section is on that list, it can keep running after the term is over.

    Search for“survive”, “survival”, “notwithstanding termination”

Some contracts offer a buyout instead: a one-time payment that replaces the tail. Read it as an exit fee under another name.

Where do you find it in your contract?

Commission after exit rarely sits in a section with that name. Search the whole document, including the definitions at the start and the last pages, where survival clauses usually are.

“Sections 4 (Commission), 7 (Confidentiality) and 9 (Indemnification) shall survive any expiration or termination of this Agreement.”

Illustrative wording, not taken from any specific agency's contract. Search for “survive”.

A line like this is easy to skim past. If the commission section is on the list, read it again with your end date in mind: what can the agency still charge, on what, and until when?

Our free contract red-flag check walks through this clause and the others that decide what you leave with. It runs in your browser and stores nothing.

What can a tail commission cost you?

The cost depends on the rate, what it's charged on and how long it runs, so put a number on it before you pick your last day.

Run the same math with your own numbers: your monthly net from your statement, times the rate in the clause, times the months it runs. If the clause is on gross, use what fans spent instead, which is your net divided by 0.8. If it has no end date, there is no total to calculate, which is the problem.

If the clause counts only fans “acquired during the term”, ask in writing how the agency will identify them and how you can check the list.

What should you check before you give notice?

Open the contract and note the clause number next to each answer.

  • Is there any clause about commission after the end date?Search for the words above, including the definitions section.
  • What is it calculated on?Net or gross, all your income or only some fans, and who decides which fans count.
  • How long does it run?A number of months, or until a condition is met. “For as long as” has no end.
  • Does a survival clause keep it alive?Check the list of sections that survive termination.
  • How will it be billed and checked?Which statements, which months, and how you can verify the fan list.
  • What is your end date?Notice period, how notice is sent and when it counts as received.
  • Is there a buyout or an exit fee?A one-time payment to leave can replace a tail or come on top of it.
  • Did anything change in writing outside the contract?Messages or emails that changed a rate or a term. Save them.

If anything is unclear, ask in writing before you send notice: “Is any commission owed on fans, sales or content after the end date? If so, under which clause, on what, and until when?”

What do fair exit terms look like?

Fair exit terms are short, have dates, and work the same in both directions.

Fair exit terms

  • Commission ends on the end date, for old fans and new ones
  • Written notice, the same length for both sides
  • No exit fee, no buyout, no auto-renewal
  • The final invoice covers work up to your last day
  • Access removed and copies deleted, confirmed in writing
  • Marketing pages and content go with you

Read twice

  • Commission on fans “acquired during the term”
  • A tail with no end date, or “for as long as”
  • A survival clause that lists the commission section
  • A buyout worked out from future earnings
  • Content or pages held “until all amounts are paid”
  • Longer notice for you than for the agency

None of these is automatically unlawful, and most are negotiable before you sign. About to sign? Ask in writing:

Hi [agency contact],

Before I sign, please add these points to the contract or confirm them in writing:

1. No commission on any fan, sale or content after the end date.
2. The final invoice covers work up to my last day, calculated on net from my statements.
3. The commission section doesn't survive termination, except for invoices on months already worked.
4. [X] days' written notice, the same for both sides, with no exit fee or buyout.

What if you've already signed a contract with a tail clause?

Move in this order, and give notice last.

  1. Put a number on it. Rate, basis, months, and which fans or content it covers. Use your statements, not the agency's reports.
  2. Ask for it in writing. Ask the agency to confirm what it will bill after your end date and how it will calculate it.
  3. Get a lawyer's view on a tail with no end date, commission on gross after exit, a buyout, or any threat to hold back your content or pages.
  4. Ask for a clean end date. It costs nothing to ask. Get any change signed, not just agreed on a call.
  5. Then give notice, without breaching anything. Keep paying invoices that are due for months already worked, and send notice the way the contract says.

After you leave, check every invoice against your statements. If a line doesn't match the clause, ask the agency to name the clause before you pay. The full exit order is in how to leave an OnlyFans agency.

Our own exit terms, for comparison:

  • No commission after the end date. None on any fan, sale or piece of content, old fans or new ones. Your last invoice covers net up to your end date and nothing after it.
  • Notice. Month-to-month, 30 days' written notice from either side. No exit fee and no auto-renewal.
  • Access and copies. Our access is removed within 24 hours of the end date, and our copies of your content are deleted within 14 days, both confirmed in writing.
